Data Request Policy
Effective Date: July 1, 2022
This page provides government agencies and private parties, including civil litigants and criminal defendants, with information about how Motive responds to formal requests for Customer Data. Capitalized terms used in this Data Request Policy that are not defined have the meaning set forth in the Motive Terms of Service.
In general, any third party seeking Customer Data should contact the Customer directly regarding such requests. The Customer has access to and controls the Customer Data and decides what to do with it.
When Motive receives requests for Customer Data, we are obligated to review them very carefully to make sure they satisfy applicable laws and to ensure we respond in a way that complies with our Terms of Service and Privacy Policy.
If you are a law enforcement agency seeking customer data, please contact Motive’s law enforcement requests team via: production@gomotive.com. You must include your badge & case number or other identifying information to allow us to verify the law enforcement agency you represent when contacting us to receive a response.
If you intend to serve Motive with legal process, we require that you serve our registered agent, Incorporating Services, Ltd., through its appropriate office (see below), and send a courtesy copy via email to production@gomotive.com to minimize any delay in our response to your request.

I am a Motive Customer and have a Motive Account, can I access my user data?
Motive’s Customers have ready access to their available user data by logging into their Motive account(s). If a Customer needs assistance identifying their user data they can contact our Support team at 855-434-3564 or at support@gomotive.com.
How Do I Serve a Subpoena or Court Order in the United States?
Motive accepts civil requests for user data (including subpoenas and court orders) issued from Delaware state or federal court, or properly domesticated out of state legal process. Motive accepts personal service through our registered agent for service of process (Incorporating Services Ltd.). Motive does not accept service of civil legal process via fax or email. Service on Motive through Incorporating Services Ltd. ensures the most efficient and timely handling of the request. Send a courtesy copy via email to production@gomotive.com to minimize any delay in our response to your request.

Our registered agent will accept service only if the entity to whom the document is directed matches the name of the entity registered with the Secretary of State (e.g., “Motive Technologies, Inc.”), and our agent is authorized to accept service on behalf of that entity. Our acceptance of legal process does not waive any legal objections we may have and may raise in response.
How Motive handles requests for user data
We carefully review each request to make sure it satisfies applicable laws. In most cases, we object to producing user and customer information, data, and records on several grounds and instead direct the requestor to seek the information, data and records from the Customer. Typical grounds for objection include:
- Improper service;
- Inadequate domestication;
- Seeking production which would cause Motive to violate the Stored Communications Act;
- Seeking information protected from disclosure by the attorney-client privilege, the work-product doctrine, and/or any other applicable privilege or protection;
- Seeking confidential or highly sensitive information, including without limitation trade secrets, proprietary and/or confidential business information, or information invading an individual’s or entity’s right of privacy, or which is otherwise prohibited from disclosure because to do so would require Motive to violate legal or contractual obligations to any other persons or entities;
- Requesting information that is publicly available, in the possession, custody, or control of the party serving subpoena or another party to the action, and/or equally available to the party serving subpoena or another party to the action;
- Vagueness and ambiguity; and
- Inadequate specificity for identification of the records sought.
When Motive receives a request, we will contact the Customer, unless legally prohibited under the terms of the request.
If Motive reasonably believes that information in our possession can prevent someone from dying or from suffering serious physical harm, we may provide information to a government agency — for example, in the case of kidnappings, suicide prevention, and missing persons cases. We still consider these requests in light of applicable laws and our policies.
What specific information does Motive need to identify an account?
- Motive fleet customer:
- Provide the unique Motive Company Account ID (“KT#######”)
- found by navigating to the Administrative tab in the Motive company dashboard
- Provide the unique Motive Company Account ID (“KT#######”)
- Motive Driver account:
- Provide the driver account username which is unique across the Motive platform
- found by logging into the Motive App and navigating to the general menu and observing the user name just above the logout button
- Provide the driver account username which is unique across the Motive platform
- Specific Vehicle:
- Provide the Vehicle ID, which is unique within a specific Motive Company Account, and the unique Motive Company Account ID
- found by navigating to the Administrative tab in the Motive company dashboard and selecting the vehicles tab
- Provide the Vehicle ID, which is unique within a specific Motive Company Account, and the unique Motive Company Account ID
How Do I Serve a Civil Request from Outside of the United States?
