The FMCSA will soon grant the Truck Renting and Leasing Association (TRALA) a 90-day ELD waiver from the ELD mandate for short-term rental trucks (defined as being rented out for 30 days or less).
As per this temporary ELD waiver, short-term rental trucks will have three more months — until March 18, 2018 — to comply with the FMCSA’s electronic logging device mandate.
TRALA announced last week that the FMCSA has agreed to this special 90-day exemption. The official notice of the waiver will be published in the Federal Register “as soon as practicable and will include the complete list of terms and conditions applicable to the waiver.”
TRALA commended the FMCSA’s support in this matter and called the FMCSA’s action “welcome news to truck rental companies that have been spending the past few months trying to put together strategies and plans to address the fact that the FMCSA only granted part of TRALA’s original request for a five-year exemption for short-term rental trucks.”
To recap, back in October 2017, TRALA requested for a 5-year ELD mandate exemption for short-term rental trucks rented for 30 days or less. The FMCSA, however, granted a temporary exemption only for trucks rented for eight or fewer days.
After that decision by the FMCSA, TRALA said that it “continued to discuss further options with the FMCSA to help ease the burden on the rental industry as TRALA members worked toward becoming fully compliant with the [ELD] mandate. After multiple calls and face-to-face discussions, TRALA requested a 90-day waiver, which the FMCSA has the ability to grant without a public comment period.”
Jake Jacoby, the President and CEO of TRALA, thanked the FMCSA for granting the ELD waiver. He said, “I want to thank the FMCSA for granting a waiver for short-term rental trucks. Having an open, honest, and productive dialogue the past few months has really helped our membership and I know our members appreciate the agency’s understanding of the unique challenges this rule presents to rental trucks.”

The FMCSA has granted temporary 90-day ELD waivers to short-term rental trucks and ag haulers, but the rest of the CMV drivers require ELDs to stay compliant.
